Most cases settle, especially those that have a fairly clear outcome if they go to trial. Usually, only cases that are unclear end up at trial.

So if Terry Martin has a rock-solid case, it is very likely to settle. The city will not cough up a ton of money to go through trial, plus get all the negative publicity, when they know they will get their ass handed to them.
